The ICC and US-Japan: The Missing Element in the Prime Minister’s Speech

Japanese Prime Minister Sanae Takaichi and U.S. President Donald Trump each spoke at the U.N. General Assembly, and the rift between the two nations concerning the International Criminal Court was made clear.

In contrast to Trump's appeal to member nations to withdraw from the organization in an effort to dismantle it, the prime minister declared support for the ICC, but she did not address the Trump administration's sanctions against Judge Tomoko Akane, the president of the ICC.

If Japan truly takes the rule of law seriously, it must coordinate with Europe and other nations to restrain Trump's reckless behavior.

In the prime minister's speech, it was natural to tout “consistent support” for international courts, including the ICC, as a general principle of Japanese diplomacy, but in order to carry out the principle, action is essential. Shouldn't Takaichi have gone a bit further and pointed out the growing danger posed by U.S. high-handedness?

In a press conference, Takaichi merely stated that, during a U.S.-Japan summit meeting with Trump before her speech, the two had engaged in a “frank exchange of views” on the ICC, but she did not provide any clear details about the discussion. It is extremely regrettable that she did not leverage the opportunity to directly request that the U.S. repeal the sanctions on Akane and others.

U.S. media report that the Trump administration is already preparing to impose broader sanctions on the ICC itself. If the sanctions, which had been limited to individuals such as Akane, are broadened to target the ICC itself, the court’s ability to function could be further harmed.

Up until now, the Japanese government has over time “repeatedly attempted to urge the U.S. at various levels”* but has not been able to prevent sanctions against Akane and others. Whether Japan will press the U.S. to lift the sanctions and prevent their expansion — and whether those efforts will produce results — is questionable.

Even if it is difficult to get Trump to understand the rule of law and the significance of the ICC, there is no other way besides persistently attempting to persuade him. Suppressing advocacy for fear of provoking resentment is the same as promoting “the rule of force.” Japanese diplomacy should focus on how to balance maintaining relations with the U.S. and international cooperation.

〈社説〉ICCと日米 首相演説に足りぬもの

高市早苗首相とトランプ米大統領が国連総会でそれぞれ演説し、国際刑事裁判所(ICC)を巡る日米の溝が鮮明になった。
 トランプ氏がICC解体に向け加盟国に脱退を迫ったのに対し、首相はICC支持を表明したが、米政権による赤根智子所長らへの制裁には触れなかった。
 米国を刺激することを避けたのだろうが、日本の立場を明確に表明すべきではなかったか。トランプ氏に遠慮するばかりでは、足元を見られるだけだ。
 トランプ氏は22日の演説で、ICCについて、米国を標的にする「邪悪な組織」と敵意をあらわにした。ベネズエラやイランに国際法違反の武力攻撃を繰り返し、赤根氏らへの制裁を発動するなど、軍事、経済の両面で「力の支配」への傾斜が目に余る。
 日本が「法の支配」を本当に重視するなら、欧州などと連携してトランプ氏の暴走に歯止めをかけなければならない。
 首相が演説で、ICCを含む国際裁判所を「一貫して支持」していると日本外交の原則を掲げたことは当然だが、原則を貫くには行動も必要だ。もう少し踏み込んで米国の横暴に対する危機感を訴えるべきではなかったか。
 首相は記者会見で、自身の演説に先立つトランプ氏との日米首脳会談で、ICCに関して「率直なやりとりを行った」と述べるにとどめ、具体的な内容は明らかにしなかった。赤根氏らへの制裁撤回を米国に直接求める機会を生かせなかったのは残念極まりない。
 トランプ政権はICC本体の幅広い取引を対象とした制裁を科す準備をすでに進めていると米メディアが報じた。赤根氏ら個人にとどめていた制裁対象が拡大されれば、ICCの機能がさらに損なわれる事態になりかねない。
 日本政府はこれまで「米国に対し累次にわたってさまざまなレベルで働きかけを行ってきた」(首相)というが、赤根氏らへの制裁を防げなかった。制裁の撤回や拡大回避を米国に促し、結果につなげられるか否かが問われる。
 トランプ氏に「法の支配」やICCの意義を理解させることが困難だとしても、粘り強く説得を続けるほかに道はない。逆恨みを恐れて主張を抑えれば「力の支配」を助長するに等しい。日本外交は対米関係の維持と国際協調の両立に知恵を絞るべきである。
