Argument for Dissolution of the ICC: The US Administration Is Wrongfully Exerting Pressure

The Trump administration is once again ramping up pressure on the International Criminal Court, which holds individuals criminally responsible for ordering and carrying out war crimes. Although the U.S. is not a member of the ICC, Secretary of State Marco Rubio has conducted a policy of pressuring member nations to withdraw, vowing to “dismantle the ICC – brick by brick, if necessary.” This unjustly challenges the rule of law that forms the foundation of the international order and it cannot be ignored.

The ICC was established in 2002, following massacres in the former Yugoslavia and Rwanda. It was formed because the International Court of Justice, which adjudicates disputes between states, was unable to hold individuals criminally responsible for perpetrating crimes against humanity, such as the slaughter of citizens and ethnic groups, justifying their actions as the exercise of government authority.

The ICC’s reason for being is as a last resort to prosecute criminal atrocities that the ICJ cannot deal with.

The Russian military’s invasion of Ukraine, and the Israeli military’s attack on the Palestinian territory of Gaza, are allegedly war crimes, and arrest warrants have been issued for Russian President Vladimir Putin and Israeli Prime Minister Benjamin Netanyahu.

However, the Trump administration has been hostile to the ICC since Trump’s first term, imposing repeated economic sanctions on the court’s judges and other parties related to the court. This hostility stems from concerns that U.S. military personnel and high-ranking Israeli officials with special ties to the U.S., risk prosecution.

Rubio pointed out that the ICC's authority “threatens American sovereignty,” but since the ICC's jurisdiction only extends to cases in which U.S. Armed Forces and similar entities commit crimes within the territory of member nations, the claims of non-member states are misdirected. Pressuring member nations to withdraw is a strike against their sovereignty and a threat to diplomatic freedom.

The U.S. has exercised military force against Venezuela and Iran claiming they are “threats to the United States,” and has been criticized for violating the sovereignty of both nations by detaining and murdering their leaders.

Making light of the sovereignty of other nations while prioritizing one’s sovereignty above all others is typical for a country that touts “rule by force.” It is precisely these leaders who oppress citizens and ethnic groups in the name of such countries that should be punished by the ICC under the law.

In 2020 and 2025, dozens of countries and regions opposed to U.S. pressure toward the ICC drafted a joint statement in protest, but the Japanese government did not participate, choosing to overlook the Trump administration's reckless behavior.

The Japanese government is the ICC's biggest financial supporter, and moreover, Japanese judge Tomoko Akane is an interested party, so to speak. Even if the Trump administration demands withdrawal and that the parties join in the pressure exerted on the ICC, Japan should persuade the U.S. to instead cooperate with the international organization.

戦争犯罪などを指示・実行した個人の刑事責任を問う国際刑事裁判所(ICC)にトランプ米政権が圧力を再び強めている。米国はICC未加盟だが、ルビオ国務長官は「あらゆる手段でICCを解体する」と加盟国に脱退を迫る方針を示した。国際秩序の基盤である「法の支配」に対する不当な挑戦であり、到底看過できない。
 ICCは旧ユーゴ、ルワンダなどでの虐殺を経て2002年に設立された。国家間の紛争を裁く国際司法裁判所(ICJ)が、国家権力を盾に市民や民族の虐殺など人道に背く犯罪を命じた個人の刑事責任を問えなかったからだ。
 ICJが対処できない暴虐を、「最後のとりで」として罪に問うのがICCの存在意義である。
 ウクライナに侵攻するロシア軍や、パレスチナ自治区ガザを攻撃したイスラエル軍には戦争犯罪の疑いがあり、ロシアのプーチン大統領とイスラエルのネタニヤフ首相に逮捕状が出ている。
 しかし、トランプ政権は1期目からICCを敵視し、所属判事ら関係者に経済制裁を重ねてきた。米国の軍人や、米国と特別な関係にあるイスラエルの高官たちが訴追される恐れがあるためだ。
 ルビオ氏はICCの権限を「米国の主権に対する侵害」と指摘するが、ICCの管轄権は加盟国の領域で米軍などが犯行に及んだ場合にのみ及ぶので、未加盟国の主張としては的外れだ。加盟国に脱退を迫ることこそが外交の自由を脅かし、主権侵害に当たる。
 米国は、ベネズエラやイランが「米国の脅威になっている」と主張して武力を行使。指導者を拘束・殺害するなど両国の主権を侵害したと非難されている。
 他国の主権を軽んじ、自国の主権のみを絶対視する姿勢は「力による支配」を掲げる国家の典型例だ。そうした国の名の下に市民や民族を虐げる指導者こそ、法に基づくICCの処罰が必要だ。
 20年と25年にICCへの米国の圧力に反対する数十カ国・地域が抗議の共同声明をまとめたが、日本政府は加わらず、トランプ政権の暴走を見過ごしてきた。
 日本はICC最大の資金拠出国かつ、所長は日本人判事の赤根智子氏が務める、いわば当事者だ。トランプ政権がICC脱退や圧力への同調を求めてきても応じず、逆に、国際機関との協調に転じるよう説得すべきである。
